Terms and Conditions

These terms and conditions shall govern your access and use of our apps. When you first create an account on our apps, you accept these Terms and Conditions ("Terms") in full; accordingly, if you disagree with these Terms or any part of these Terms, you must not use any of our apps. In this document, "we", "us" and "our" refer to Leaflet®.

You must be at least 17 years of age to create an account on any of our apps. By signing up for an account, you confirm that your age is at least 17 years old.

The services we provide

The core services we provide are creating, managing and deploying electronic leaflets. We offer pharmaceutical companies a complete solution to distribute quality content to their patients and healthcare professionals. Our services aim at improving the quality of medicinal information provided to patients. This will help achieving more equitable care and social justice for patients with disability and their families

Using Leaflet®

You may use our apps only if you can legally form a binding contract with us, and only in compliance with these Terms and all applicable laws. When you create an account with us, you must provide us with accurate and complete information. Any use or access by anyone under the age of 17 is prohibited. If you’re based in the EEA, you may only use our apps if you are over the age at which you can provide consent to data processing under the laws of your country.

Our license to you

Subject to these Terms and our other policies, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our services. All rights not expressly granted are to the extent permitted by law reserved by us.

Your content: Licence

In these Terms, "your content" means all materials including without limitation Text, Graphics, Images, Links that you post to us for storage or publication on, processing by, or transmission via, our apps.

You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, distribute, adapt, store and, with your specific consent, publish your content on and in relation to our apps.

You grant to us the right to sub-license the rights licensed under this section. You grant to us the right to bring an action for infringement of the rights licensed under this section.

You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.

You may edit your content to the extent permitted using the editing functionality made available on our apps.

Without prejudice to our other rights under these terms and conditions, if you breach any provision of these Terms in any way, or if we reasonably suspect that you have breached these Terms in any way, we may delete, unpublish or edit any or all of your content.

Your content: Rules

You warrant and represent that your content will comply with these Terms. You are solely responsible for your content, whether publicly posted or privately transmitted. We do not take the responsibility for your content.

Your content must not be illegal or unlawful, must not infringe any person's legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).

Your content, and the use of your content by us in accordance with these Terms, must not:

(a) be libellous or maliciously false;

(b) be obscene or indecent;

(c) infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;

(d) infringe any right of confidence, right of privacy or right under data protection legislation;

(e) constitute negligent advice or contain any negligent statement;

(f) constitute an incitement to commit a crime, instructions for the commission of a crime or the promotion of criminal activity;

(g) be in contempt of any court, or in breach of any court order;

(h) be in breach of racial or religious hatred or discrimination legislation;

(i) be blasphemous;

(j) be in breach of official secrets legislation;

(k) be in breach of any contractual obligation owed to any person;

(l) depict violence in an explicit, graphic or gratuitous manner;

(m) be pornographic, lewd, suggestive or sexually explicit;

(n) be untrue, false, inaccurate or misleading;

(o) consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;

(p) constitute spam;

(q) be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory; or

(r) cause annoyance, inconvenience or needless anxiety to any person.

We don't allow content that is overtly sexual or promotes sexually explicit content like pornography, or intended to be sexually gratifying, such violations may include, but not limited to:

(a) sex acts or sexually suggestive poses;

(b) promotional photos of sex toys;

(d) promoting escort services that provide sexual acts in exchange for compensation;

We don't allow content that encourages violence or promotes illegal activities, such violations may include, but not limited to:

(a) depictions of realistic violence or violent activities, like bomb-making;

(b) promoting acts where serious injury or death may result, like self-harm or suicide;

(d) encouraging the sale of prescription drugs without a prescription;

Account Deletion

You may choose to delete your account and remove your content completely, this can be done by sending us a removal request by email at support@leaflet.healthcare.

Breaches of these Terms

Without prejudice to our other rights under these Terms, if you breach these Terms in any way, or if we reasonably suspect that you have breached these Terms in any way, we may:

(a) send you one or more formal warnings;

(b) temporarily suspend your access to our apps;

(d) commence legal action against you, whether for breach of contract or otherwise;

Where we suspend your access to our apps, you must not take any action to circumvent such suspension (including without limitation creating and/or using a different account).

Copyright policy

We respect the intellectual property rights of others and we expect you to do the same. If you believe that any content provided by another user infringes any copyrights or trademark rights, please notify us immediately by sending a Digital Millennium Copyright Act (“DMCA”) notice by email.

You must not violate any laws in your jurisdiction, including but not limited to any copyright laws. Leaflet® claims no intellectual property rights over any of the content or data you upload or add to the Service. All data added to the app by you or users of your account retains its original ownership.

You must obtain written permission from our side to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.

Acceptable use

You must not:

(a) use our apps in any way or take any action that causes, or may cause, damage to the apps or impairment of the performance, availability or accessibility of the apps;

(b) use our apps in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;

(c) use our apps to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, virus, trojan horse, worm, keystroke logger, rootkit or other malicious softwares;

(d) conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our apps without our express written consent;

(e) access or otherwise interact with our apps using any robot, spider or other automated means;

(f) use data collected from our apps for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).

You must not use data collected from our apps to contact individuals, companies or other persons or entities.

You must ensure that all the information you supply to us through our apps, or in relation to us, is true, accurate, current, complete and non-misleading.

Security

We work hard to protect the security of your content and account. You are responsible for safeguarding the password or credentials that you use to access your account. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements. Please notify us immediately of any compromise or unauthorized use of your account.

Third party links

Leaflet® may contain links to third party websites, services, or other activities that are not owned or controlled by us. We don’t endorse or assume any responsibility for any such third party sites, information, materials, products, or services. If you access any third party link from Leaflet®, you do so at your own risk and you agree that we have no liability arising from that.

Limited warranties

We do not warrant or represent:

(a) the completeness or accuracy of the information published on our apps;

(b) that the material on our apps is up to date; or

The service we provide at Leaflet® is free of charge, its use is voluntary. We reserve the right to discontinue or alter any or all of our apps and services, and to stop publishing our apps, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any app or service, or if we stop publishing our apps.

To the maximum extent permitted by applicable law and subject to the section "Limitations and exclusions of liability", we exclude all representations and warranties relating to the subject matter of these Terms, our apps and the use of our apps.

Limitations and exclusions of liability

Nothing in these Terms will:

(a) limit or exclude any liability for death or personal injury resulting from negligence;

(b) limit or exclude any liability for fraud or fraudulent misrepresentation;

(d) exclude any liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this section and elsewhere in these Terms:

(a) are subject to this section; and

(b) govern all liabilities arising under these Terms or relating to the subject matter of these Terms, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these Terms.

To the extent that our apps and the information and services on our apps are provided free of charge, we will not be liable for any loss or damage of any nature.

We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control. We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill. We will not be liable to you in respect of any loss or corruption of any data, database or software. We will not be liable to you in respect of any special, indirect or consequential loss or damage.

You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the apps or these Terms (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).

Disclaimers

Our service and all content on Leaflet® is provided on an "as is" basis without warranty of any kind, whether express or implied. We can't guarantee it will be safe and secure or will work perfectly all the time. We specifically disclaim any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade.

We takes no responsibility and assumes no liability for any type of content that you or any other person posts or sends through our service. We don’t control what people would do, write, or say while using our service. We are not responsible for your (or their) actions, conduct, or content.

You understand and agree that you may be exposed to content that’s inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose, and you agree that we shall not be liable for any damages you allege to incur as a result of user content.

Variation

We may revise these terms and conditions from time to time.

If you have given your express agreement to these Terms, we will ask for your express agreement to any revision of these Terms; and if you do not give your express agreement to the revised Terms within such period as we may specify, we will suspend your account, and you must stop using our apps.

Assignment

You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these Terms. You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these Terms.

Severability

If a provision of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision of these Terms would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These Terms, together with our privacy policy, shall constitute the entire agreement between you and us in relation to your use of our apps and shall supersede all previous agreements between you and us in relation to your use of our apps.

Law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with Jordan Law. Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Jordan.

Unsolicited Material

We appreciate any feedback or suggestions from you, you understand and agree that we may use them without any restrictions or obligation to compensate you for them, and are under no obligation to keep them confidential.
